how does the do not disturb feature work is it only when you phone is in lock screen mode because when my phone is open it doesnt work

I noticed that my phone rings whenever the phone is not lock but as soon as it locks thats when it doesnt ring.....this is very annoying because the feature should work in both modes, is this just happening to my phone or is this how this feature really works

iPhone 4, iOS 5.1.1

From the iPhone Manual:

Turn off all notifications: Go to Settings and turn on Do Not Disturb. When it’s turned on and iPhone is locked, all notifications and calls are silenced, but alarms will still sound. You can set the following options in Settings > Notifications > Do Not Disturb:

Automatically turn on Do Not Disturb: Set the starting and ending hours for when you don’t want to be disturbed. iPhone turns on Do Not Disturb during these hours each day.
Allow some phone calls during Do Not Disturb: When Do Not Disturb is on, calls are silently sent to voice mail. To allow some callers to ring through, tap Allow Calls From. You can allow calls from your Favorites list or other Contacts groups you define. For information about Favorites, see Chapter 25, Contacts, on page 100.
Allow persistant callers to ring through: Turn on Repeated Calls. If the same caller (based on their Caller ID) calls you twice within three minutes, iPhone will ring.

Oops ... your posting above says you're running iOS 5.1.1. That version of iOS does not have do not disturb. You need iOS 6 for that feature.

I'm actually not running on iOS 5.1.2 I can't update my profile because it doesn't have 6 in the bar but I have ios6 and it only works in the lock screen which is stupid

OK, that is how it's designed ...

Look at Settings > Notifications > Do Not Disturb. Here's what it says at the top (I added underline for your reference):

When Do Not Disturb is enabled, calls and alerts that arrive while locked will be silenced, and a moon icon will appear in the status bar.

Totally skipped pass that part where it said that I guess that defeats the purpose of even having a do not disturb I'm so used to my blackberry do not disturb function where it works while its in lock screen and off lock screen

Actually, the designed algorithm makes sense to me. If the phone is unlocked, you're probably using it (or at the very least you've recently used it), so an incoming call would be OK.

If you want to turn off the phone (which would send incoming calls directly to voicemail), but keep WiFi on, you can do that as follows (these two steps in order):

1. Turn on airplane mode.

2. Turn on WiFi.

You will then have no cellular service (for phone or data), but you will have WiFi.
