Instagram App & Kids under 13

Hi,

I just found out that my 11-year old son recently downloaded Instagram on his iPod Touch. I asked him if Instagram rejected him when he tried to register since he's under age. He said it din't ask him to put in birthdate or anything, and all he did was put in the Apple ID (which is my Apple ID).

When we gave him the iPod Touch, I did set up parental controls to only allow apps for 12+. Apparently, Instagram went through. When I changed the control to allow apps 9+, Instagram and some other apps were gone.

Could someone please confirm that Instagram checks for age limitation based on the Apple ID which is used to download the app?
