AirPods Pro Second Gen Siri Problems

1. Will not respond to Siri or hey siri

2. When I activate Siri it does not do my commands

i have tried

forget device and then reconnecting multiple times. Occasionally it takes me through the initial set up (i.e. announce notifications, use Siri) but it never gives me the option to train Siri, other times it just connects
confirmed iPhone and AirPod software is up to date
have mic option to automatically switch ear
confirmed no restrictions on Siri
