Brand new Apple pencil Gen 2 not working

I've tried everything suggested (force restart of iPad Air Gen 5, software is up-to-date, pencil shows connected then Forget Device and reconnect...is charged 70%...it hasn't worked yet--won't draw, won't swipe screen--nothing. Do I have a lemon?
