Q: Rights/Usage of samples and songs packaged with Jam Packs/GB/Logic

The best document I could find on my question is this... http://support.apple.com/kb/HT2931

I'm editing a feature film and using Temporary Music and FX that I make in Garage Band while editing.

If the Music Supervisor wants to use these temporary tracks that I'm making in the final movie, and let's say the movie was a hit and made it to the theaters, do I have permission to use the samples, loops and songs that came with Garagband for free?

The above link I posted seems to say that, *but it doesn't mention the Entire Songs* that are included with garage band.

Also I want to buy the jam packs and possibly Logic if I'm allowed to use the content as I stated, but I don't want to invest in this new software/samples unless I'm allowed to use it on a movie with distribution.

Macbook Pro, Mac OS X (10.4.11), 3 gigs ram - 2.4 duo

    As the document says:

+You may use the Apple and third party audio loop content (Audio Content), contained in or otherwise included with the Apple Software, _*on a royalty-free basis*_, to create your own original music compositions or audio projects. *You may broadcast and/or distribute your own music compositions or audio projects that were created using the Audio Content*+

_*however, individual audio loops may not be commercially or otherwise distributed on a standalone basis, nor may they be repackaged in whole or in part as audio samples, sound effects or music beds.*_"

meaning that you can use the loops in any of your projects that might be commercially released...but you are not allowed to repack/include individually/standalone in a samples/loops package for sale.....

As the last paragraph of the Knowledge base's document says :

_So don't worry, you can make commercial music with GarageBand, *you just can't distribute the loops as loops*_.

    I think it's clear enough

EDIT: what do you mean by>>> *but it doesn't mention the Entire Songs that are included with garage band*

...I don't use Garageband...but if there are demo songs(full compositions/projects) included with it...I think you can not use those. There should be a license agreement saying so.
Logic Pro 9 comes with Demo songs, when you open the song you can read on a note that you are not allowed to touch these(use parts etc) in any way.

I guess it's still up in the air then. I noticed you edited your message to include my main concern (thanks!), I'm curious if the words "Audio Content" include the full songs in garageband, jam packs or logic.

I don't see any warning not to use these, for example in Fruity Loops, their demo songs have the author and copyright on a splash page before you play them, so it's right in your face that the song is not yours by purchasing the product.

I wish Apple's term "Audio Content" or "Loop Content" explained what's entailed.

If you buy, for example' the sympahy Jam Pack disc, there are full orchestral scores on there which are consolidated (you can't access individual tracks), why include these if they're not yours to keep/use?

I'm not asking you specifically, just stating that this is not clear. It's hard to imagine that a full song can be considered a "loop", yet it's hard to imagine that they sell you these songs, yet they are not mine to use.

If I was working on a YouTube project, I wouldn't even care, I'd just use it. But I am working on a commercial release and would hate to recommend to my clients content that I'm not 100% sure I have the rights to.

    Thanks for your time!

Yes I did because it's not clear to me what you mean by full songs.I don't have any full songs in my apple loops library. Could you be more specific please by giving an example(name) of which is the full song you want to use?

It is very clear (to me at least)

If you buy, for example' the sympahy Jam Pack disc, there are full orchestral scores on there which are consolidated (you can't access individual tracks), why include these if they're not yours to keep/use?

Which is/are the file(s) you are referring to from the Symphony Jam Pack? So I can check what you mean

I'm not asking you specifically, just stating that this is not clear. It's hard to imagine that a full song can be considered a "loop", yet it's hard to imagine that they sell you these songs, yet they are not mine to use.
