If they have been opened it would seem likely that they have been used.
There is nothing of a technical nature to stop you using it once someone else has installed it. It's arguable that if you don't know that it has been installed then you can install it in good faith. The opposite is also arguable.

Thanks Terence.... my only concern would be that if they had used it (I.E they lied to me) when I come to update from time to time will this bite me in the bum if it has been registered prior to me using it.?
I have always bought new retail copies in the past or have had all the new stuff when i upgrade my lap top?
