Open iTunes. Go to menu item "Store"->"View my Account". You should be asked for your password. Then your account will be showed.

Right in the middle of the window should be your purchase history (showing the date of your latest purchase). Just right from it will be something like "View all". Klick that.

Now you should see a list with all your purchases. Lion should be there too. Below the list should be a big button labeled "Report a problem". Klick that.

Now the list of your purchases should have a "Report a problem" line right from each item. Look for Lion, klick the corresponding "Report a problem".

Now you should see a form where you can state your problem with Lion (in my case "don't work as expected" did it). State that you want your money back. send the form. In my case it took around five days for the refund to arrive.

I have persevered with Lion now for a week, and I can't say how disappointed I am.

The cosmetics of it are great. It looks good.

But the performance, certainly in my case, has been woefully slow.

I just tried the steps above in order to get a refund, and got forwarded to an apple site with FAQs.

Long story short, I have booked a call for tomorrow, so it will be interesting to hear what they will say.

I've just re-installed Snow Leopard, and the performance is back...

Thanks for your views and advice.

I was rejected by them using this method.

They said any purchase made on iTunes is not refundable.

So I felt really bad because we didn't have any other way to upgrade to lion besides iTunes, correct?

Then that means, should there be any problem with the upgrade, it's nonrefundable, no matter what....

I felt we deserve an apology from apple for that.

Update:

I insisted getting a refund. And this morning I got a reply saying the refund was allowed.
