Q: m4p to Aiff or using in FCP

I understand that this has been asked before and there are issues regarding legal rights to use music, LIcensing etc.   Generally, I can understand that but I have a serious problem that I have posed to Itunes store.  I doubt that I will get an answer or that it will be anything satisfactory.  Certainly it won't be prompt enough to help me here.  I also don't think anyone here will be able to assist me before my project is due.   

 

I purchased music from the Itunes Store, some time ago, that I believed was "Production Music"  Generally the words "Production Music" mean that you are free to use it and reproduce it in your PRODUCTIONS.  Either through performances, ceremonies, audio or video.   I purchasesed a few sets containing Holiday, Patriotic and Classical music pieces that could be used for Weddings, Veterans Day, Memorial Day etc.   I am working on a Christmas Video and had hoped to use one of these intstrumental cuts from Valentino Production Series for the beginning.  Now I find that somewhere along the way, I lost those rights to the music and can not use them in FCP nor can I duplicate them to a CD. 

 

I can't help but think I have been cheated and fraudulantly enticed to buy something that I now find is of absolutely no use to me.     Any Help would be appreciated or at least.  I hope I can make people aware of what I believe is a severe wrong doing on the part of APPLE.

    The Terms and Conditions of the iTunes Store have always been very clear on that point:

     

    You shall be authorized to use iTunes Products only for personal, noncommercial use.

     

    They are not licensed for any other purpose.  You cannot even use the iTunes Store songs to DJ in public, much less to use in your own productions.

    Yes, for most of the iTunes products I would agree.  In fact, I have spent an enormous amount of money lately on Royalty Free Music to use comercially because I don't want to infringe on copyrigths.  However, they should have some way of separating or not selling products that would seem to be free use and then contradict that term and condition.   Say I wanted to use it in a video for a personal and non commercial purpose.  I still  would not be able to.   The issue here is selling a product that by it's description is intended to be free use and then not allowing it to be used for it's intended purpose.  I still think that is wrong.    I will research The Valentino Production Library on Google and see if I am not misunderstanding it's purpose.  I may be wrong.   However, if it is what I think, It is wrong that I can buy it from them or one of their other distributers and have all licensing right but simply because I bought it from iTunes, I don't get those same rights.

    Doiwjeoriehorwierwoih,  The licensing issue and the conversion issue are not one and the same.

     

    The .m4p DRM "protected" tracks cannot be converted precisely because they are "protected."  If you want the same song for an allowable non-commercial purpose, you can either burn it to audio CD or upgrade it to iTunes Plus.

    Yes, that's them USA.  I just looked and they are listed.   I am confused as through their website they list various levels of products including annual liceses and "BUY OUT" libraries.   Looking in the Buyout, there are only 5 volumes listed.   The one that I seem to have bought is Specialty Volume 10 and I don't see that on tvmusic.   iTunes still sells that one and it seems to have an assortment that might be from the other libraries.  One of the songs that I bought may also be on Vol 57.    Again, my whole gripe is that, despite the Terms and Conditions as mentioned above, this product gives a different impression of it's usability.  Thus why I bought the Volume for $10. I am sure I was able to use it once before, when I first bought it, and even copy all the music to a CD, which I now can't find.   But somewhere along the line, with all the updates and revisions and evolutions of iTunes Store, I have lost my ability to use my music, along with everything else i BOUGHT.  Now, buying from the iTunes library doesn't seem to be as convenient as buying a CD from Amazon or Best Buy.  Except that the space that is taken up by all the hard copies of CDs. 

     

    Not to venture off too far though, this is a big part of my whole reluctance to upgrade to the newest iTunes, Quicktime, LIon or iCloud.   My understanding is that iCloud will be so great in that iTunes can take all of your iTunes library, even what you own on CDs and upload it to the cloud.  Then you can access it from all your mac enabled devices.   I think I read that they can even replace and convert it to iTunes files....   Then What,  Change it all to m4p files that you can't burn to a CD or use unless you have an iPhone, iPad, or iPod?    I am just afraid that once my content gets PULLED up to the cloud, I loose all control of it.    If I want to PUSH something to a cloud on my own choice, that is great.  In fact, I do that regularly with video files that I want to send to people.  But, I don't want the cloud grabbing stuff from my devices.  But, that is another issue and separate from this.

    I don't know about the iTunes Plus.  I will check that.  But, I knnow as I tried, I can NOT burn it to an audio CD.   It gives me the same error that it is right protected and can't be converted to mp3 on a CD.  As for a regular CD, I don't know.  But that may not do me much good if that file isn't importable to Soundtrack Pro.

    Are you referring to iTunes or Valentino?   i did send an email to iTunes through their Support page.   I am trying the iTunes Plus thing now.   There were two libraries that came up that i Had bought through iTunes  AudioMagic and Valentino.   They were $3 each to upgrade.  Hopefully that will work.    Thanks for the suggestion above about that.  I know I wouldn't get such help from iTunes.

    If any of you out there are FCP users and Editors...  I can't recoomend Digital Juce enough.   I have turned into a junkie.   In fact, after this, I might see if some of their other specials are still valid and might snap up some more music while it is still available.

    It is very easy to upgrade songs to iTunes Plus.  For 30 cents a track you will get unprotected versions.  See here for the procedure:  http://support.apple.com/kb/HT1711

     

    And yes, you can burn protected tracks to an audio CD (but not an MP3 CD), as long as your iTunes is authorized to the account from which the track was originally purchased.

    Thanks for the help.  I didn't expect to get this much this fast.   I did upgrade to iTunes Pluse.  It cost $3 per Volume in question.  I think my whole iTunes library would cost $30 bucks.  I added in a few Music Videos that were especially classic to me.   I will wait on the rest.   It was very easy once I found out how to get to the iTunes Plus selection.

    iCloud membership is free and includes Mail, Contacts and Calendars, Find My phone (or Mac). Songs purchased on one device can automatically download to others.

     

    iTunes Match is $25 for a year.

    You tell iTunes Match to upload your music to the server and your other devices can load them from there. Nothing is "pulled".

    If you have .mp3 or mp4 at lower bit rates in your collection and those tracks are available on iTunes Store, it sends you the higher bit rate Store version. Think of it as a back up with benefits. You do not "lose control" of your Library, it is still right there on the computer. Even if you let Match expire, any songs that you downloaded in better quality remain yours. Apple no longer has m4p titles. They are DRM free m4a.

    No free lunch with these guy's ... It's a reoccurring fee ... to use electronic devices and/or "media" in the United States and other Nations... and Youtube is going to be taking a big hit, I'm sure there are others ... As now, when ones tries now to upload a file to some site's, one must agree to let a "Legal Entity" and all that implies ...control and/or manage YOUR account ...  before you upload ...


    Nice deal the FCC and Industry have worked out for themselves ... HUH


    Will just change my focus ... but, for the creative and those who may have a different opinion
