Did you call the store to find out? They may be out of retail stock, but Apple usually has backup replacement units available for this type of thing. They always have in the past. They obviously can't sell those as new becasue they don't come with the box, accessories, etc... but they are new units. I'm hoping my storee will have some available.

@cosmicdust73 - well unfortunately there is no apple stores in my country. They are all authorized resellers and Im not exactly sure if they use new units to replace defective ones. It seems to be refurbished though...

Off topic I know but Safari don't work for me in the icloud.com interface. Can't select any options in Calendar etc. I have to use Firefox to access icloud.com. I suppose I could use Chrome just to really go for the ironic slant.......

They clearly saw that the one I brought in had the yellow tint and even opened the new one to make sure it was brighter, but compared to my ipad 2 the new one is still not as bright.

Guys, just let it settle in. If its still like it after a week take it to apple and they will exchange.

This also happened with the iPad 2 when it came out. It's just the adheasive they use to bond the LCD to the glass. They are shipping them as fast as they can make them and it's not completely dried yet.
In the case of the iPad 2's this cleared iteslf up in about a week. Hang in there, it should go way on its own.

It seems to depend on the angle you hold it s well, stight on seems fine but slightly angled and its yellow...bizarre lol

No, that's not normal. I am extremely fussy about display quality, in fact I bought an iPad in the first place to use as a portable studio-quality monitor. (Which it is… among other things.) Before buying a 2012 iPad I very carefully inspected the display on a store-model unit at the Apple Store with a number of demanding test images I have. Here are URLs for two of them:
The new iPad was slightly yellow-greener in color cast than my iPad2, but the difference was slight and the new iPad was actually more neutral in overall color balance. Overall grayscale neutrality, color saturation and color discrimination looked to be just as good as on the old iPad.
I checked my purchased unit against my old iPad and it looked essentially the same as the store unit. When I got both iPads home, I compared them to my custom-calibrated and profiled iMac display; the new iPad was a closer match to that display than my old one.
Anyone who is seeing a strong color cast or desaturated/funky color rendition definitely has a substandard display and should get a replacement iPad If it doesn't clear up on its own.

I don't have a definite yellowish tint, but I do have a slightly dingy greyish tint that extends from the top (in portrait mode, home button at bottom) down about 2 inches and fades out completely at about three inches down. I suppose one could call it a very light dirty 'yellow'. The rest of the display is great.
I suspect this very slight defect is a glue drying problem as it was with early iPad 2s, but I did not have the problem with either of my iPad 2s or my original iPad so I can't be sure it even looks the same way.
The new display is definitely not as bright at the same level of the brightness slider as my iPad 2. The colors, however, are much closer to my color managed monitor than are those of my iPad 2.
