Reporting a lost or stolen Apple product
If you have lost or found an Apple product, please contact your local law enforcement agency to report it. Although Apple does not have a process to track or flag lost or stolen product, you can use My Support Profile to find a list of serial numbers that have been purchased or registered with your Apple ID.You might also find the following checklist useful:

Do you now who it might be? Or are you just saying that its been restored because Find my iPhone won't work? If you have proof of purchase check the receipt for something that looks like an apple serial number, This is your physical evidence that your the owner along with the 'My Support Profile' which shows serial numbers registered to your Apple ID.
... I would definitely contact your local law enforcment ASAP if you have any idea who it is.
I feel sorry for you man.

It was both easy to report and best of all free!
