Sleep setting for drives only apply to when the machine is powered up.  If the drives are still spinning when the lid is closed, it is not going to sleep.  There simply isn't any power to the drives when the system is sleeping.  When you close the lid to put your system to sleep, does the LED on the front begin to flash or does it just stay on?  You indicated it started after your last update, so something may be preventing your system from sleeping properly.

Yes when I close the lid the white light on the front is constantly on, and I can hear the hard drive humming away. like I said it was always silent until my last update

If the light isn't flashing, then it's not sleeping.  Basically, the display is going off, but something is preventing it from sleeping.  As you've just done an update, try going into Disk Utility, select your drive and then repair permissions.  Sometimes during an update, there can be permissions issues (especially if they were there before the update).  It'll just take a minute or two.  After it finishes, restart your system to make sure you have a clean boot and then try sleeping again.

Permissions are basically the rights your login has to write/read, etc.  Sometimes, things can happen with your system that can cause permissions to get screwed up.  As a result, some things that might need to happen on shutdown get prevented so your system just hangs.  It's a fairly rare occurrence.
