I don't believe that any third-party shop can send an iPhone to Apple for replacement unless that shop is authorized as an Apple service center, something I've not heard of for any company that isn't an authorized iPhone dealer. I think you're being lied to.
Insist on seeing the sealed box from Apple - the box will have a clear label from Apple on it. Then open the box, find the serial number from Apple, and enter it via the link WJ posted, or call Apple support, give them the serial number, and ask for status. If the shop won't cooperate with that, then you're almost certainly being lied to.

thanks thats very useful - and i certainly plan to do that, if he does not co-operate I guess I will just have to get in contact with the police or trading standards. I'm so angry with this shop. I am going to check the serial of the phone he has given me as Ive no idea where it came from either. I think I will pay a visit to the shop tomorrow with my husband or ex poloce inspector father in-law then perhaps he may decide to take me more seriously.

Just spoke to apple no sign of an out of warranty replacement request for a phone with my serial no. Anyone can request and out of warranty replacement for a phone so long as they have the serial number. I am v.suspiscious now as Apple have no sign of this on their system. I think I will have to check when I am in the shop when the other phone comes in and see the status of the new phone and check if there is 90 days warranty on it, if not then I suppose next stop is police.

Just one more question - i am a novice at all this, I took the sim card out of the phone when i gave it to the shop - Would all of my contacts photos and apps still be on it? - Im concerned they will see private data. I know am I soundig pretty niave but this really is all new to me Im getting more and more worried about this. Thanks again

On what? On the phone? If you didn't wipe it, then they were on it when you handed it to them. Whether they are still there is a mystery right up there with "If a man speaks in the forest, and there is no woman there to hear him, is he still wrong"? (my wife insists the answer is yes)...
You probably should have erased the phone before giving it to them, but there's no sense in worrying about it now.
