Do I need to contact Apple because of this? It shows it in the same location but when we can' t find it. We are scared a neighbor stoled it. It pin points it across their house.

First off, NO, and iPod can not power on by itself. If its off, then its off. An iPod is an inanimate object. It is not alive, and it can not be turned on by remote control. Ergo, a living breathing entity like a human being must press the Sleep/Wake button.
Second, if Find My iPod shows YOUR iPod as being in some one's house, then there is a better than even chance that's where the iPod is. If that is your neighbor's house, then your neighbor has your iPod.
If you don't want to confront the neighbor, then your only option is to go to the police.
