If you don't have an AT&T account, it can NOT be unlocked.

All round it's a bit poor service from Apple / AT&T. I have legitimately purchased a second hand iPhone 4 that is locked to AT&T but is out of contract and not barred / blocked / etc. I am willing to pay for the phone to be unlocked by AT&T but that is not an option. I live in the UK so I cannot take out a new AT&T contract. If the previous owner rang up they would honour the unlock request by why would the previous owner ring up - it's not their phone anymore.

All very poor customer service. I speak to Apple and they are less then helpful...

It's not Apple's responsibility to do anything, the carrier is the one that locks the phone. As for AT&T; It makes sense for them to only unlock the device if the original owner calls up, for all they know you're just a friend of the original owner, who just wants to unlock his/her iPhone because they don't like AT&T anymore, they need confirmation from the person who purchased the device on a contract since that's who they have on record as owner of the device.

I'm not aware of any carrier that will just unlock a device for you if you're not the original owner

You did not "legitimately purchase" anything. You bought a gray market phone. AT&T has no obligation to unlock it for you. Their only obligation would be to the original purchaser of the phone, and then, only if they completed the terms of their contract, paid AT&T's early termination fee, or could provide proof of purchase from an authorized source for a no-commitment phone.

Apple does not have the legal right to unlock the phone without a directive to do so from AT&T.

You did not do your homework before you made a purchase.  The fault is yours.

My cell phone operators in Germany to buy Vodafone.I ask them to unlock things. They said that I need to go to Apple to unlock.I was very angry and very confused.Does the apple really can unlock it?Supplement, they said 2-year contract expires, you can go to the Apple unlock
