Aug 14, 2012 2:59 AM in response to Dah•veedby asiliram,It was not an audiobook... but an App.. that is an interactive book. So nothing to do with that kind of licensing. Sorry for my unclear post.

Aug 14, 2012 3:03 AM in response to asiliramby Dah•veed,It doesn't matter if it was music, a video, an audiobook, an app, a gane or anything else from the iTunes Store, which all carry the same End User License Agreement and are covered by the iTunes Store Terms of Use, it still does not come with a license to give it to someone else.

Aug 14, 2012 3:09 AM in response to Dah•veedby asiliram,I am not really giving it to someoneelse.. as it was bought for the kids!! I understand what you are trying to say but I strongly disagree. They need to find a way to acommodate situations like this. I see this similar to an earlier post where the kids grew up and got their own phone and own appleId.. and then had to buy everything over again.

Aug 14, 2012 3:58 AM in response to asiliramby Dah•veed,Unfortunately, this isn't the process for buying something for the kids. That process involves gifting iTunes content or giving them a gift certificate that can be redeemed for the item. However you wish to spin it, this isn't what the topic of this thread is about.

Aug 14, 2012 4:05 AM in response to Dah•veedby asiliram,I hear your point. But I strongly disagree. Kids are 3 and 5 years old.. there will be years before they have their own iPad and appleId. I am sure you could argue your point in many of the other previous posts in this thread as well. However, I do consider this being the same thing. And we are not only talking about combining 2 appleIds in this thread as far as I have read.
I don't se any point in discussing this any further so I guess we have to just agree to disagree. :-)

Aug 14, 2012 4:44 AM in response to Dah•veedby Willcarter,Dahveed -- You continue to take a deeply unattractive line in this discussion. I realise you are reading from the statute, and refuse to see anything other than black and white. You are probably technically right in most of your pronouncements, speaking legalistically.
But please, why not try at least to show a little empathy? You take the line that anyone who even dares to ask questions around this subject is guilty of "piracy", o planning to commit some sort of theft. Why not try to be a little more understanding towards people asking what appear to be pretty reasonable questions who are clearly not thieves or software pirates?
I think the position of most people who have contributed to this thread is that Apple should at least acknowledge that there are situations when a respectable person behaving reasonably might want or need to transfer an app to someone else. Maybe it was originally bought with the intention of giving it to someone else; maybe it was bought by Person A who quickly decides that it isn't suitable, but that Person B would love it. Whatever, the fact is that these are everyday occurrences that law-abiding, respectable, reasonable people experience and it would be ethical for Apple to at least recognize that this happens, and that it is a million miles from preplanned software piracy -- which nearly all would agree is A Bad Thing.
Other software vendors manage it. Other media vendors manage it. Other licence sellers manage it. Either by permitting transfer under certain circumstances, or allowing transfer for a fee, or allowing a refund within an appropriate period, or allowing paricular vendors to make their own decision.
I have bought at least 20 premium apps that I bought and then decided I didn't want. Opened once or twice, then never again. I should be able to give these to my relatives who are students, who I know could not afford to buy them but would get good use out of them. I'm certain the developers would prefer that I could transfer the apps to someone who would be using them and spreading the word - and possibly buying additional licence extensions in future etc.
Try to see over those magisterial blinkers.
Thank you.

Aug 14, 2012 5:05 AM in response to Willcarterby Dah•veed,You are certainly entitled to your opinion, however, there are a number of issues that are raised in your comment that don't fit the issue.
1. This is a different model than that used by Apple in the past and other software venders.
2. The model of distribution used for the Mac App Store (MAS) is licensed use of a copy of the software, not licensed ownership of a copy of the software.
3. The Licensed Application End User Licence Agreement, which we all have agreed to when we use the MAS, limits the use of the Licensed Application to ourselves and our immediatel family members living under the same roof, with the proviso of also covering a child living away from home during enrollment in a college or university.
4. The LAEULA also does not provide for the transfer of the software to anyone else. It requires that others purchase their own use of the software.
5. If the developers of the software made available through the MAS were not in agreement with the model used by the MAS, then they would not be making their software available through the MAS.
6. If folks don't like this model, as far as a Mac is concerned, since this is the Mac App Store forum, they are free to purchase Mac software from someone else. No one has to buy Mac software through the Mac App Store.
Yes, it is cut & dried. Yes it is legalistic. However, its the facts.
And if you haven't quite figured this thread out yet, this is a honey pot. The ASC hosts allow this thread to continue, however, they would likely remove this same topic if someone tried to start it up in another thread. The honey attracts the buzzy bees and keeps them from bothering others elsewhere.

Aug 14, 2012 5:13 AM in response to Dah•veedby asiliram,We all know that currently IT IS NOT POSSIBLE... to do what we all want. Hence why we got here in the first place! You, however, are not being helpful nor contributing with your responses. People seek forums for help, understanding and maybe together we can try and change something.
You are being the 1 against the rest of us... for some strange reason I do not understand. We don't need someone to quote facts or give accusations. Hence why so many get frustrated with your responses.
Together we might be able to change something.
I keep being an optimist that Apple also might want to listen to the customers needs when developing their products. So there needs to be a place to voice these needs... and also again I incurage everyone to send mail to Apple Feedback as well.

Aug 14, 2012 6:13 AM in response to Dah•veedby Willcarter,Wow -- I rest my case. In response to an observation that you are behaving like a robot in a law school, you.... behave like a robot in a law school.
My point was, why not try to see the human side of this issue? The information you provide is indeed of help in understanding some of the legal and contractual issues, but instead of just churning out the regulations like some defective fax machine, at least try to display a tinge of personality.
I'm fairly new to Apple, and like most people I'm impressed with their hardware and their understanding of human needs when it comes to interface design and all the touchy feely stuff like the experience of opening the box. They are not without an appreciation of human values.
But they seemed to leave all those insights at the door when they started designing their ownership and licensing model.

Aug 21, 2012 7:39 AM in response to Lan_Holmesby ryanbirch,Another silly example.. my wife just got back from a convention in Salt Lake City where a large MLM company gave away free iPad 2's to all who signed up to be associates. She waited in line for 6 hours to get one for me! The company had pre-loaded 3 apps that, from what I can tell, THEY developed in-house and installed on all these iPads they gave away.
My wife already has the new iPad, so all she asked is that I transfer the apps to hers before I wipe this one and set it up for myself. Simple right? Apparently not. I may be missing some details, but the way I see it, this company GAVE us (and a bunch of other people) a free iPad, and GAVE us three apps that THEY developed, but because of Apple's ridiculous policy, we can't MOVE the apps from one iPad to another! I tried searching in the app store for them, but they are not there.
Actually.. "silly" is an understatement.
My wife has since emailed a rep that she met down there asking if there's a place we can download them from or something.. we'll see what they say.

Sep 7, 2012 2:20 PM in response to Lan_Holmesby Willcarter,I'm confused.
I keep getting email notifications of replies to this discussion, but when I click on the link to read the recent posts, the message I've been emailed is not visible, and seems not to exist.
Are these posts that are being deleted because they express awkward or inconvenient opinions? Or is there a simpler, more pleasant explanation?

Sep 7, 2012 2:25 PM in response to Willcarterby Dah•veed,No, it's because new posts on a thread this long, it's 8 pages at this point, get placed on the last page, no matter to whom they are in responding. The cheappo software that is ASC doesn't have the ability to take you to a comment once the thread gets beyond a page or two.
