You should be aware that iOS 3.1.3 is as high as a 1st generation Touch can go and that many Apps require a higher version than iOS 3.1.3 and therefore will not work on a 1st gen Touch.
You can check which version of iOS any App requires by looking at the Requirements list on the page for that App.
