Some states charge sales tax on the discounted cost of the phone but some charge it on the full retail cost, even though that's not what you actually paid. Have you tried contacting your carrier?

I dont know if you got an answer to this yet, but i am also from mass and when i pre-ordered mine it also had the 40.00 sales tax in there based on the origional 649.00 price tag. But after a few hours once my order went from "submitted" to "processing" the final price was then 211.and change. Thats what went through my cc. I think the system just does that at first. I also know that a friend of mine didnt order his through a computer he did it through his iPad on iOs and it was the correct amount from the beginning. I hope this answers your question.

I have been waiting for a post like this. Just ordered mine from AT&T and the tax is close to $52. At an 8% mark that also equals to $649. I think they are charging full retail sales tax. I called AT&T and they couldn't explain it to easily they started saying that there is an extra luxury tax but I think they don't know it's just full retail tax. They also said that it's just a hold on my card by final charge will be processed when the phone gets shipped.
I checked fine print of sprint and AT&T. Ecause when you upgrade online with AT&T you don't pay tax but it states that it will be collected at the time it shipped. Sprint charges $24 which is almost half but also claims that there might be an extra tax when it shipped.
I am puzzled by the whole issue. But 25 bucks won't get me not to order my phone. I was able to get credit from my carrier because of the competition in the form of statement credits. Ordered 2 phones and een after crazy high tax I got one for red plus some :). Tax is crazy anyone else order it an have this issue please share

If you think it's crazy just for the buyer, think about the retailer who has to actually understand the rules and regulations, and pay it correctly to the state. Keep in mind also that they are the ones who get penalized if something goes wrong. And people wonder why Business owners are mad at the government.

I ordered my Iphone 5 its a 64gb version on a $399 charge I got charged $61.55 of tax which solves to 15.42% worth of sales tax. My county tax is 7.25%. This sales tax charge is plain fraud = daytime robbery. I am going to Apple store to get my refund!!!

Futureall, the retailer is only following the law. You're paying sales tax on the full retail price - before discounting by the cellular carrier. Instead of going to Apple, I suggest protesting to the lawmakers.

I found this tax regulation 1585 of california state board of equalization. It is ridiculous. Its not something I ever voted for.
We need to grow support to repeal this. its a ripoff law!

I am going to dig deep on how to initiate a repeal. And forward it to governor Brown or whoever can sign off on it.
13 years? I wonder anyone ever tried fighting it. Is it even possible to fight it?
