Who sold you the iPad? Apple or AT&T? It seems to me, that you should take this up with the AT&T store. This isn't Apple's fault. If you don't want the iPad, take it back to the AT&T store.
BTW... Did you ask if it was the iPad 4?

Att will let me exchange the ipad for another ipad 3 or another tablet of my choice. I didn't ask if it was a ipad 4. I asked if this was a brand new ipad and the guy who helped me said yes. When I went back to complain he told me he was unaware there was an ipad 4. He looked it up on apple and he only saw ipad, ipad 2 and new ipad and thats what he is selling. I feel sorry for the guy because he said he really felt bad he sold me an ipad I didnt like. My complaint is I wish Apple would package their ipad 3 or 4 to be more distinguished. Poor guy had no idea what an ipad 4 was, and unfortunately, I had no idea what an ipad 4 package would look like. I assummed ATT would only sell new product.
Quick question for you?
Does the ipad 4 say Ipad 4 on the package or does the ipad 3 and 4 have the same packaging?
As far as I can see the ipad 3 and 4 both say ipad with no distinction. I have a doctorate degree and even the packaging fooled me. So please explain to me how the average consumer can look at ipad 3 and 4 side by side and know the difference.

Apparently you got the latest iPad with the old connector? So what? You have just paid around $800 (not counting the cost for your data plan) and did not notice that it doesn't have the latest connector. You might want to spend another $30 for an adapter. You could buy it online, at a retail store or just go to an Apple Store. The only main difference between the new iPad and the latest iPad is really the connector and a few grams of weight - I acknowledge the different processor (which really is not necessarily noticeable) and the improved front camera (are you really using it that much?) as well as the abilitiy to use LTE (more interesting for residents in the UK, which limited to the 4G network) . Unless of course your real aim was to buy the iPad mini which is not released as cellular model yet.
It doesn't get PhD to figure out that the adapter will solve yor problem; although I have a PhD as well...
Otherwise sell the iPad and get " a newer" one.

the newest ipad has a 6x processor that runs o n 1.4 mhz versus a 5x processor that runs at 1mhz. the ipad 4 runs at twice the speed as an ipad 3. Sorry but the main reason I am mad is not the ipad itself. It is the poor packaging.

Thank you for your replay bhazel. I just wanted to gauge how many people got confused by the apple packaging. It seems I am the only one dumb enough. I will hire a lawyer and take apple to small claims court and see how they respond to my complaint on the packaging of the ipad 3 and 4 being the same.

okay you can take them to court but you didnt buy it from apple and it is att fault that they would let you exchange it and yours and att fault that you bought the wrong one. maybe your should have paid more attention when you went to purchase it

No apple didnt sell me the product. But apple made the poor packing causing confusion to me and the sales rep at att. If i showed you the front of a 3rd gen and 4th gen ipad could you distinguish between the two? The thing is the box for the ipad 3rd and 4th are exactly the same. The only way to know is to look at the model number at the bottom right of the package. If you have no knowledge of what the model numbers are, could you tell which is 3rd or 4th. The only way would be to go online and check the model number. Even that is a task itself. So explain to me where the poor packing is not true?

For those who plan on buying an IPAD LTE from ATT ,here is how you can tell the difference.
Look for the model number in the back bottom right.
3rd gen ipad - MODEL A1430
4th gen ipad - MODEL A1459
Please refuse MODEL A1430 and insist you want one that is A1459.

Turn over the box and look at the white label at the lower corner. There is a description of the ipad and what the box includes. If you see the word "lightning" anywhere on the label, then you know it is the newest ipad.

If it really ran at 1mhz it would be slower than molasses , its Ghz.
