What version of iOS do you currently have? I don't believe Apple supports the 2nd-gen iPod Touch past iOS 4.

Well, how do you check?
The only thing I can do is check my settings and go to general and all I see is a version number. Is that it?
The version number is : 3.1.2 (7D11).

Look on the back of the case. A 2nd gen iPod will have a 2008 Apple trademark on the back. 3rd gen will not. 2nd gen devices cannot be upgraded past iOS 4.2.1
That 3.1.2 would be your iOS version. Plug your device into iTunes and on the device About screen you will have the option to update your iPod. Hopefully this was what you needed. Good luck.
