two Iphone 5 with factory defect right out of the box

First black Iphone 5 bought the 16th of November right out of the box with a small scratch on the edge.

the Apple store did not want to exchange it with a brand new one, only a refurb. I refused.

My operator change it the following day with a brand new retail box, the second one has a small scuff

on  the volume down button.

Apple knows thes defects, but do not want to exchange them for brand new retail box.

They say you have to buy it from an Apple store.

Mine was bought from telecom shop with a phone contract.

Is there any issue for this.

Any help would be appreciated.

    Apple does not exchange from new retail stock for warranty issues.  They only replace from service stock, comes in a brown box, which may be new or refurbished.


    They offered to replace the device and you chose to refuse the replacement... what exactly do you want?

    No one said you are getting a refurb.  Apple is simply providing a unit from service stock which may be new or refurb.  Considering the iPhone5 has been out for only about a month, it's unlikely there is any refurb units in the service stock.


    Stop being so dramatic.

    You get the same warranty regardless of which replacement unit you get.
