Brought what on themselves, turning you into a criminal?

Distributing someone else's app is a crime. It doesn't matter what your justification is. It's still a crime.

Posting on a public forum that you are doing so is moronic.

i don't expect you understanding anything about what I'm talking about... am I a criminal for getting my paid app to work?

just as a general idea: whatsapp 2.8.3 and 2.8.4 is the same app from the same developer and I paid for 2.8.3 so... I feell fully entitled to the 2.8.4 update the only problem is that apple no longer offers it because a newer version was released (which incidentally is not compatible with my phone)

Jailbreaking is not illegal. It simply forfeits your right to support and voids any warranty and Apple Care agreement.

What is illegal is downloading a copy of the app from anywhere other than the app store. If you have not done so, then you don't have a problem.

If you have done so, then you are a thief. Plain and simple.

Whether you feel entitled to do so is irrelevant so far as the law is concerned.

Are you a lawyer knowing copyright laws from every country in the world? Apple can put anything they want into their terms of service, this will still not invalidate local laws. As far as I'm informed some countries do allow you to copy software that you legally bought.

I am not a lawyer and the above mentioned is not meant as a legal advice.

Whatsapp is a U.S. corporation. The application, and distribution of the app are covered under US copyright law.

And this is written where? They can't change the laws in the countries they're selling their stuff at, and thats a good thing.

And again: I am not a lawyer and the above mentioned is not meant as a legal advice.

If you want to argue the legality of distributing someone else's app, then wait until you are sued and hire a lawyer. In almost every country on the planet, you are free to make a copy for backup purposes. You are NOT free to distribute that copy to anyone else, and you are not free to download bootleg copies off the internet and call it a "backup".

I didn't say that I wanted to do that, did I? You just don't seem to know that US law doesn't automatically kick in in a foreign country, just because a US company is selling stuff there. Can german law be applied in the US, just because people there are driving around in BMW and Audi?

This is correct, in ALMOST every country. As far as I can tell, the people posting here seem to be from all over the world.

So calling somebody a thief is a generalization which shouldn't be done.

That statement was being made specifically in regards to downloading the app from an unauthorized source. It is only officially distributed through the app store. Anything else is a violation of law.

Maybe you should pay attention to the conversation.

I think I do pay attention to the conversation. Can you link to the passage which states that it as an unauthorized source? And even if, "unauthorized by Apple" is not the same as "illegal". Maybe thats Apple's definition of "unauthorized", but Apple fortunately doesn't make the Rules about whats legal and what's not. They also tried to make jailbreaking illegal and failed.

I don't say that I am necessarily right, but thats my interpretation based on the information I have.
