1) Call Apple to check if it's unlocked. However, there is still a possibility that the phone has been hacked, so while it may be unlocked now, something as simple as a software update could re-lock it. Since you are not buying from a legitimate source there really is no 100% assurance that it is unlocked.
2) If it is truly unlocked, yes.
3) These are restrictions put in place by carriers. Just get a dead SIM for free.
4) No data is stored on the SIM. Again, any SIM will work, you can use your friend's, then give it back to him.

The problem is you purchased an iPhone from a non-official source, thus whether it is in fact officially unlocked or not is anyone's guess. Most non-official sources, for iPhones, that state the phone is "factory" unlocked, have actually "hacked" the phone to unlock it.

It is to my understanding that the iphone 5 is unable to be jailbroken/hacked at this time. It was from a partnered seller from amazon, and I doubt amazon would partner with them if they were doing something like this. And, it was all sealed as if from apple themselves. In the box, wrapped in the plastic.

It's your money, do what you like. We get posts here, everyday, from users just like yourself, who purchase "factory unlocked" iPhones...4, 4S & 5...from places like Amazon.
None of these places are authorized sources for the iPhone, and they don't post here because they're not having issues.

the phone is in fact unlocked, wish i could change my thanks to 'this solved my question' to the first poster. Called up apple, they verified it was unlocked, and I'm all good. really I was just worrying about whether the the activation screen meant something bad, but I'm confident in it now.
