If the phone is defective and has not been jailbroken and is under warranty any Apple store will replace it.

What if the phone has never been jailbroken and warranty expired? My warranty ended 3 days before IOS 6.1 update was rolled out.
I believe Apple should take care (FOC) of the phones which stopped working due to IOS update.

I've know Apple stores to make an exception if your warranty has only recently expired, but it's up to the local store manager. You may want to visit and ask.

I was responding to someone who SAID their phone was jailbroken; I was not talking to you. If yours isn't jailbroken read my other post. https://discussions.apple.com/message/21579241?ac_cid=tw123456#21169947
