Why do you believe this is true?

What I meant was, what exactly is happening that makes you believe someone is spying on your phone.

If your phone is not jailbroken or hacked, then no spyware can be installed.

If you use iMessage, and you believe someone else can read those messages, change the password for your Apple ID.

Unless your iPhone was jailbroken, something which would probably have required someone to have physical access to your iPhone for quite a while, then your iPhone has not been hacked. If you believe that someone has access to your iMessages, change the password for the Apple ID you use for that function. If you believe that someone has obtained access to your SMS/MMS messages in some way, talk to your cell carrier. The same would apply if you believe this person can listen to your phone calls.

Quick battery use or slow service is not an indication that your iPhone has been compromised, though it doesn't rule it out either. I'd suggest you reset your iPhone:

and if that doesn't help restore it:

    http://support.apple.com/kb/HT1414

If you try restoring from a backup and that doesn't fix the battery and performance problem, try restoring to factory settings and synching your apps. You'll lose the app data and settings, but if the problem is due to a corrupt cache or settings file, that should cure it.

If the iPhone is jailbroken, restoring it may fail, so if that happens, post back and we may be able to provide additional advice.

    Regards.
