That's because you have an iPhone 3G, not 3GS. The last update available for the 3G is 4.2.1 - the phone hardware can't support anything later.

If you plug into iTunes and do check for update, you should get the option to upgrade to 6.1.2
You cannot do an update over the air unless you have version 5 or higher.

When I update, itunes informs me that this is the current version. I tried re-setting to factory but this also only goes to version 4.0. I did notice that when you plug the phone into Ttunes it says that it is a 3G. I am wondering whether the previous owner has replaced the back cover (as it looks brand new) and has sold it has a 3GS instead of a 3G on Ebay. Unfortunately this means that this is the 3rd phone I have bought as a 3GS and have turned out to be 3G's.
