Go to Settings>iCloud, tap Delete Account, the sign back in with the new ID. This deletes the account and your synced data from your phone, but not from iCloud. Provided you are signing back into the same account, your data will be synced back to your phone when you sign back in. However, if you are changing to a new account, choose Keep on My iPhone when Prompted. Then choose Merge when you sign into the new account to upload your data.
Prior to deleting the account, if you have any photo stream photos that you want to keep, save them to your camera roll (tap Edit, tap all the photos, tap Share, tap Save to Camera Roll).

What if you do not have a valid password for the old email address and the phone keeps asking you to sign into to that email address to delete the account and you can not????

Sounds like you are running iOS 7 with Find My iPhone turned on? If so, do the following:
1. Sign onto Manage your Apple ID and change your Apple ID back to the old ID (this is temporary - do NOT verify this address, do NOT change your password): Apple - My Apple ID
2. Go to Settings>iCloud, scroll to the bottom and press Delete Account. Type in your current password when asked, and then follow the prompts to complete the deletion
3. Go back to Manage your Apple ID and change your ID back to the new ID (you may need to verify it again)
4. Go back to Settings>iCloud and sign on with the new ID
