I received an email today that my Apple ID was used to sign into the cloud on a iPhone 5, however I do not have a iPhone 5 and believe someone downloaded my iCloud backup to their device. How can I find out who the device belongs to that did this?

iCloud

Try contacting Apple, and change your iCloud password: http://support.apple.com/kb/HE36.

Click on "Get Started" here: http://www.apple.com/support/icloud/contact/.  Choose something like Account and Setup>Topic Not Listed, follow the prompts and click on Talk to Apple Support Now.  You will have to provide your device serial number.  There would normally be a charge for this (unless your device is less than 90 days old or you paid for AppleCare), but you can argue that there has been a security breach on your iCloud account and you shouldn't be charged for the call and see if they will waive the fee.

    Awesome. Thanks.

    You're welcome.  Good luck.

Also, if you change your iCloud password, you'll have to go to Settings>iCloud, tap Delete Account, then sign back in with the new password.  This will only delete the account and you synced data from your device, not from iCloud.  As long as you are signing back into the same account, your data will be synced back when you sign back in.  You should, however, save your photo stream photos to your camera roll prior to deleting the account (by tapping Edit, tap the photos, tap Share, tap Save to Camera Roll.)

FYI to follow up - I just spoke with Apple support they said they cannot access that information on where or what phone my iCloud backup was downloaded too. I asked if I can get law enforcement involved and she said you can try, but not sure what that will do because we don't have access to that information since it's your iCloud account. She suggested I login to the find my iPhone app and search for the phone that downloaded my data that way or look on my devices and see if the phone is registered and has a serial number. Looks like I am stuck with changing my password and hope whom ever downloaded my phone doesn't do anything with the information on it.

I was afraid that might be the case but wasn't sure.  If their device is listed in Find My iPhone you could also issue a remote erase.  Then change your password.

Good ideas. I did login into find my iPhone app and don't see an additional phone. Hoping they will turn on location services if they are going to use the phone.

I can't believe Apple can't tell you what phone my account my iCloud was downloaded too. I am assuming their databases can track the serial numbers of phone and when those phones access the iCloud. Or at least have an IP address of where the data was downloaded from, but I guess there are 125 million iCloud accounts with millions of users updating, backing up and downloading data. So maybe I'm not surprised they don't have any information. Anyway. Tha is again for your help and suggestions.

You're welcome.  Even if they did have an IP address, they probably wouldn't give it to you without a court order.  Anyway, good luck.
