Apple Care Customer Assistance instead of Apple Customer assistance?

i have a mid-2009 MBP that has given me fits out of the box. battery life was atrocious, it heated up considerably, the fan blew loud, then i started noticing beachball hangs on normal operation for safari and mac mail.


i brought it into the genius bar multiple times and since i was a returning mac user they successfully sent me away for the better part of two years with various "explanations" on what the problem may be (the explanations were always variations on user error) with one tech indicating that i should not expect all that much from the 13" model of the mac pro line.


a month before my applecare expired i brought it in and then finally did something based upon a service battery alert (new battery, then a failed test and a new logic board, then a failed test then re-seat the logic board).


since this time i have contacted Apple Customer Service and run Capture Datas designed to point out very weird issues on wake from sleep or wake from shutdown or seemingly very fast battery drain upon shutting the case and going into sleep mode - as well as beachball hangs upon RESTART with no startup menu items and no software running.


i just got back from a trip and felt like a total idiot having to get out my power cord to power up this thing after it being in my bag for 3 days after fully charging before i left and then i have to sit around like a neanderthal waiting for the thing to startup so i can simply get on the internet to try and change a flight during a snowstorm.


anyway - sorry for the venting but i ran a set of /generic/ capture datas at MAC CUSTOMER SUPPORT'S REQUEST 43 days ago (!!!!) after they told me that the weeks i spent on trying to document these problems on my own in a text file and with capture datas based upon my own testing was for some reason not possible for them to analyze.


is it possible to get with APPLECARE WARRANTY instead of APPLE CUSTOMER SUPPORT on this?


i feel like the genius bar has been hustling me for three years and 43 days with no follow up does not inspire much confidence in - well - in /anything/ having to do with this machine.
