You should take it in to an Apple Store Genius Bar.
No need for a warranty. It may be a simple 10 second cleaning.
At least they could likely tell you waht it is.

All of a sudden the home button became stuck in the down position. I called Apple and was shocked by the response I got..."you're 34 days out of your 90 day warranty but if you want to purchase an extended warranty I can help you." WHAT? Is this how Apple supports its products?! I was flabbergasted! Gotta tell ya, NOT impressed with Apple, it's customer service OR it's products! Why in the world should a home button stick after only 4 months of use?!?!?!?
I started to search online to find answers and finally came across your post about the assistive touch. We did get that to work so she is at least able to navigate again. THANK YOU!

No.
All Apple products come with a 1 year warranty.
You get 90 days phone support. After that it is like $29 for phone support.
Take it to an Apple Store genius bar and have them look at it.

I used this after spending hours trying to unstuck it with different techniques, and honestly I can't afford repairing it via apple since I bought my ipod 4th G years ago.
Just remember:
TURN OFF YOUR IPOD BEFORE YOU APPLY THE ALCOHOL, let it dry for a few minutes, then turn it back on. It's just a way of prevention.

Apr 18, 2013 6:40 AM in response to ikijimiby lakota53916,we're first time ipod users too. assistive touch puts an icon on your screen that allows you to do a few different things. For my daughter, it is now the only way she can get back to her home screen. It's pretty easy to find and set up....you go to settings, general, accessibility, then assitive touch. I had to google fixes for a stuck home button and this is the only thing that I have found that works...at least till I can get it to an Apple "genius" (ha!)

I too have had this "conumdrum", and actually my iPhone was brand new (less than thirty days). Knowing this an iPod thread that issue still applies as we are here for 'Apple' devices.
(just doesn't make sense designing hardware at such rediculous prices to fail straight away, my experiance of ALL Apple devices GIVEN to me as I never buy such obvious FAILURES!!!! I hate seeing others being so sucked into these FADS! - this outburst after seeing 11 pages of one thread for only one device of design fault across probably all iPods, sorry 8hrs trying to 'fix')
