Not likely if you added personal info on there, like password you can't easier remember or names or phone numbers and PICTURES. Other than that, not really.
Apple will do nothing without a court order.

May 17, 2013 6:16 AM in response to andrevieirby Ralph Landry1,The only items that can be tracked are those on which the iCloud/Find My function can be turned on, such as the iPad, iPod Touch, iPhone, MacBook Pro. If you have account information on the Nano you should immediately change all of your passwords on those accounts.

Aug 25, 2013 1:27 PM in response to Jayne16by Ralph Landry1,The only way to track or in any way contact a device is if it has a version of iOS or Mac OS X installed that allows access to iCloud and allows input to the operating system. You must be able to turn on a Find My function that connects with the Find My Phone function in iCloud. Without that you cannot find or contact your device, which is a long way of saying you cannot find an iPod Nano in this manner.
