In your Phone, go to Settings->General->About, and Tap on your phone's Name.

Try Resetting your Phone. Hold down on the Home and Power/Sleep buttons at the same time until the Apple Logo Shows up. This will Reboot the iPhone.
Other than that, is this a corporate Phone? If so it may be restricted in some way to change the name.

There are restrictions but I have not set them, the iphone has a previous owner who claims he did not set the restrictions. I wonder is there a way to retrieve the code to change the restrictions?

Your best bet is to Restore the Phone to factory condition to remove everything and anything that may be preventing modifications including any restrictions that are in place.

The previous owner should have done this before giving you the phone.
