Same issue happened to me redarding the disk utility error. Coincidentally with an OWC drive trying to install on a Mini server that I replaced one of the 5400RPM drives. It did not matter what slot I put the SSD in or which drive I left in the mini. I reformatted each drive seperately and tried re-installing. I even re-installed ML on the SSD and it built the recovery partition etc. Interestingly the issue does not show up using disk utility when the sytem is booted from the primary drive, just when booted from recovery partition. Called OWC and they said they hadn't heard of the issue.
RRFS, did you find a solution? For now I guess we're just living with it.
