That definitely sounds frustrating! If you haven't already done so, does restarting or resetting the iPad help the issue?
If not, you may want to restore your iPad using a computer with iTunes. Please be sure to backup your iPhone first.
Note: Restoring your iPad will update it to iOS 7.

I have done all that and the volume is still faulty.
Apple is saying my warranty has expired so I need to pay to replace with a new iPad.

I am having the same problem. I believe it arose only after I install the latest software update, 7.0.4. I would appreciate a fix.
