FWIW, all my Apple TV's are set to something other than 'never' and they have never encountered any issues, so I think it's probably back to your network as the problem, but you may have discovered a workaround.

Perhaps you're right...but, you sound like the techs that kept pointing to everything but the Apple TV...and who never thought of the simple fix. Keep in mind that we have 7 iPhones, 4 Macs, 4 iPads and 3 iPods roaming around in our home. I'm using the latest version of Time Capsule as my router - which is functioning flawlessly. None of these devices have this problem. Also, you might check out the following example of the same problem others have had (and there are still other links):
