No you do not need go upgrade to fix this
Turn messages off in settings.
Reboot - hold sleep and home buttons at same time until the apple logo appears. Release.
After it restarts, turn messages back on.
Alternately, or as well as try a reset, general, reset, reset network settings.

It's all messages, I can get iMessages via my iPad but nothing coming through on my phone. I'm using Movistar at the moment as I'm in Spain, should I ask them?
If it is all messages, then it's a carrier issue. Contact your wireless carrier.
