Be sure to run a software update as typically the disc has version 10.6.3 but the latest version is 10.6.8.

Better to download and apply the combo updater which will bring you straight to 10.6.8:

If you actually have a MacBook Pro with Retina display, as your tag suggests, you probably won't be able to run SL 10.6.8.
If you're referencing a Model A1278, which is a non Retina MacBook Pro 13", it shipped with Lion 10.7.4, so I doubt that it will run SL either.
You need to identify the actual Mac that you want to use with SL.

I have replaced the bad a had drive and have formated the new one.
While I am waiting for the arrival of the disk from apple, is there any program I can download to boot from to test out this?
Also, since my bad hard drive still has some data on it, is there a program that can copy this from the old to new before I load the OS on the new?
