Bought a second hand iPhone 4S a month ago. Has never worked properly, shop won't give me a refund?

Posting here because I'm fed up and really need advice.


I bought a second hand iPhone from a well known electronics shop in my local town. The phone has never worked properly, no signal in certain places where people on the same network have full signal, not sending messages, not able to connect to internet or receive calls. I went to 2 different network provider shops and they said the problem was with the phone, not the network, and to return the phone to where I bought it.


I returned the phone to the shop I bought it in, and they told me, "the problem is with Apple and their software, we tested the phone and found no problem, therefore we can't give you a refund. We will lend you another phone and download the software fix when Apple releases it." (claiming the recent ios 7.0.3 release would fix the bugs they thought were causing the problem).


I returned to the shop on Friday and got my phone back with the newest software installed. The phone is as bad as ever, they even gave me a broken charger. I'm beyond fed up as this has gone on for over a month. Do I have any rights here at all, or am I £220 out of pocket for a phone that does not work.
