If you bought it new, it would not have a password.  It does have a password, so it is absolutely not new.

You need the password, Ask the seller..

You will have to get the info from him, or have him remote erase and remove it from his account.  Otherwise, Activation lock will not allow you to change the info to yours.

You bought a stolen iphone. That is the newest way thieves are getting suckers to buy stolen iphones. Sorry but you got suckered and you should have never bought it from someone you do not know.

So if you went to his house and got the charger and accessories then go there and have him put the password in.

Let's be honest, you purchased a used iPhone from a guy..No Password..

Use a friends email to contact him and request the Password..

I know you are not stupid - But you did buy a used iPhone without getting the Code!!!!

Did you get the origianl receipt that would work enough to call applecare

If you can reach him have him turn off Find My iPhone on the 4s. He can do this remotely.

If that isn't done you will not be able to use this phone.
