Out of warranty replacement/upgrade

I was getting in the car to go to work and sat my iPad 2 32GB on the roof of my car, to unclock my car, as my hands were full.  I forgot that I put it there, and started driving down the road, when I heard a thud.  I didn't know what it was, so I backed up to see if I had hit anything, and when backing up, I think I backed over it.  Do you think there is any chance of the Genusises at the Apple Store having some mercy on me and allowing me to pay $299 instead of$249 and get a refurbished iPad 3, instead of a 2.

    You can try asking, but the replacement policy is like-for-like

     

    If it is 'completely destroyed' as you say in your duplicate thread :

    Certain damage is ineligible for out-of-warranty service, including catastrophic damage, such as the device separating into multiple pieces, and inoperability caused by unauthorized modifications. However, an iPad that has failed due to contact with liquid may be eligible for out-of-warranty service.

    See if your homeowners insurance will cover it.
