he sold it to me and i confirmed with apple that the device belonged to him. i verified name and email of the owner to the serial number.
and he refuses to unlock it without paying a $500 ransom. i already bought it from him for $160.
ive contacted police they wouldnt help they jsut told me they cant do anything about it. i contacted apple on getting it unlocked and they refused to help. -

While it is despicable behavior for someone to knowingly do this sort of thing, I doubt there is anything inherently criminal about it (at least not in the USA). If they sold it through eBay or somewhere, you might try complaining to eBay (or whomever) about it - I don't know what sort of disclosure requirements they might have for sellers in such a situation.

A.) but the bad part of it is, do you login throu your email on the phone? bc u can still see the email where u sent it by going on your pc and locate your sended msgs and see what email it sent to.
B.) Direct the email of the original email user of the phone to email it itself still hiding the email making you never see it.
Making it secured n such but i do see advantages & dissavantages to this.
I'm not taking any sides to this, just leaving this idea out to you all n Apple should do is do Option B which I cant confirm this idea.
No, I nvr had an iPhone, only New iPod touch throu Apple Site's Store n Paying it there.

I have the same problem I just bought the 5s for $500 and it was locked and I don't know what to do about it. I tried to call the person back but he did not anser the phone. And I'm stuck with it. It's like buying a brick for $500

The police won't help because you actually have the device you paid for in your possession. That it does not work is a civil matter of warranty and merchantibility of goods.
The exception would be if you catch that eprson extorting another sum of money off you for deactivating. This is criminal. If you get them on email or text message stating this, or a witness to the comment, you can and should file charges.
Rule of thumb when purchaing a used iDevice: Always activate BEFORE handing over the money.

Therein lies the whole issue. You made a private purchase of a personal used item, which usually are indeed sold "as is". Most consumer law doesn't offer much help in such situations of purely private party personal property commerce, except in cases of egregious fraud (for example, somebody claiming to sell you an iPhone 5 when in fact they actually ship you an iPhone 3g or something clearly not what was originally advertised for sale).
You can talk to a police officer about it, or your lawyer, and see just what legal recourse you may have, but the simple plain fact of things are, there is not much you really can do. You bought it as is, and the sole responsibility for the entire transaction pretty much lies with you as the buyer and the seller.
One possible legal basis for pursuing things may be that the seller advertised a functional iPhone (or the advertisment clearly implied a functional device), and in fact, because of something in fact under their direct control, the device is effectively non-functional? Sort of like selling you a car but refusing to give you the keys to it after its been dropped off in your driveway. I don't know how that would fly in court, but it may be some basis for legal action against the seller - talk to your lawyer about it.

You should file a police complaint. "As is" plus a request for more money is extortion. Combined with the original sale of a device known to be non-functioning without a passkey, that is fraud (they deliberately hid infomration from the bargin in order to demand further comensation later). Both fraud and extortion are criminal. If the iPhone simply does not work, that is civil. Caveat emptor.
In both criminal and civl actions you will need positive identification. If he is texting you that can be utilized.
There is no other way.

Two scenarios
1. His device and he extorts you.
2. Stolen device and he s thief or helps a thief.
Devices like that are sold on ebay for parts for around 200 bucks and prices go down, cause more and more people realize that those phones can only be used for parts.

same problem here 2 like Jassim.almutairi, i agree with SarahSaleem i got this iphone 4s from someone the phone had ios 6.1.3 but when i updated to ios7 my phone remained stucked in activation mode and i need this password and email of the ex-owner of the phone and i can't reach him, so i'm waiting that apple will allow this users who have the same problem to downgrade to ios 6 or do something, i can't imagine that i paid 200 euro's for an item that is not working because of apple.

It is NOT Apple's fault.
You never reset it BEFORE the purchase.
You cannot use any iPhone without the previous user wiping their identity from it first.
It is likely you are out 200 Euros.
