With Activation Lock, you need the Apple ID and password used to first activate the phone. If you purchased this second hand, then you need to contact the seller to have them remove the phone from their iCloud account. See this support document http://support.apple.com/kb/HT5661

Apple's going to tell you the same thing.  You will need to use iforgot.apple.com to recover your Apple ID if you've forgotten it, or your password to your Apple ID if you've forgotten that.  While they might be able to help with password recovery if you are able to verify your identity to their requirements, if your Apple ID is not the one used to enable Activation Lock on that device, then they won't be able to help you.

Are you the ORIGINAL purchaser of this iPhone?

"Apple is not doing anything about it" because it is behaving as it was programmed. Activation Lock is working correctly as designed.

"Activation Lock is working correctly as designed" Actually no it's not. I gave my iPhone 4 to my nephew and it was fine until he tried to upgrade to iOS7 same problem as those people above so he contacted me. I gave him my iTunes account still no joy. He retured the phone to me and I have tried but it just wont activate. I have the receipt and a trip to the Apple store is needed to fix this ~ so no it doesn't work as designed.

So you handed over an iPhone to your nephew with YOUR iCloud account set up on it, along with Find my iPhone why, exactly?

No not correct I handed my iPhone to my sister in June 2012 who used it without problems signing in with HER iCloud account. Two years later she asked if her son my nephew could use the phone. Again NO PROBLEM - he updated the o/s to iOS 7 - PROBLEMS. A combination of my apple ID her apple id and my nephew's will not clear the problem. I bought the phone at the apple store in person and still have the receipt and I know there's only been three accounts on that phone from factory. So there's my story. The activation changes for iOS7 just do not work unless you being so smart can explain what we are doing wrong.

I agree, it is NOT working as intended.  I gave my iphone 4S to my dad and he's in Pakistan. It was on ios 7 when I gave it to him and it was working fine for over 6 months. Then a week ago, he restarted the phone and it said this phone has been deleted and he needs to enter the apple id that was used to erase it.  It wont even give him the hint of the first letter and the email domain. That phone has only used 2 ID's, mine and my dad's. He's tried both, and each time he gets the error, this ID cannot be used to unlock this iPhone. When I sign into icloud my apple id and password work, however, there are no devices listed, so there's nothing I can delete.  When I sign into iCloud with his id, it says iCloud needs to be activated on a device with his id. However, I know the id and password are correct because when I go to manage my Apple id, I can sign in with his id and password.  I called apple and they were no help either.  Now I'm going to ask him to ship the phone or send it back to th states with somene so I can try to use a restore from itunes on it, since I still have backups of that phone on my computer.  So glad I left Apple, such a huge pain in the butt!!!!

In the meantime, if anyone else does figure out a solution for this, please let me know, would save my dad from this headache.

Same is happening to me. I have an unblocked iphone 4 (has always been mine) for traveling purpose.

I reset the phone, bought a sim card for it and now itunes is asking for an itunes account I don't even know!

I will follow this thread to see if a solution comes.

I have the same issue with you. I turn off "Find my phone" to update ios 8 from beta version(but cannot because network issue). When the beta expired, the iphone ask me activate with a g**** account same first letter with my current account; but it don't let me activate because mine cannot be used to unlock. The customer service keep tell me reset password blah blah but mine is fine.
