I have backed up 710 photos to the Icloud and then downloaded them to a new device but the downloaded only had 74 photos, why?

Are you sure it's done restoring the backup? Check Settings>iCloud>Storage & Backup. At the bottom of the screen it will say "Stop Restoring..." if it's still restoring the backup.
