NetFlix is rated 12+. So, under Settings>General>Restrictions>Allowed Content>Apps, you'd have to have at least that level enabled.

I have that setting correct, the problem with accessing netflix app only happens when I restrict websites.

i have websites restricted because the ipad is setup for my daughter. is there a way to use the netflix app with website restrictions enabled

Consider using Guided Access, which would limit the device's use to a single app as described here:
