You must go to the App Store, not the iTunes Store.

Are you trying to download iPhoto iOS again, for your iPhone or iPad? iPhoto is no longer available for mobile devices. You can migrate your iPhoto libraries on iPhone and iPad to the Photos.app, see:  Migrating from iPhoto for iOS to Photos on iOS 8

I'm trying to download it for my mac pro. Once I downloaded Yosemite the iphoto does not work anymore. So I went ahead and trash the app and attempted to reinstall. When I did that it gave me the same message " this update is not available for this apple ID either because it was bought by a different user or the item was refunded or cancelled."

Contact the App Store support personnel to sort this out via this website:  http://www.apple.com/support/mac/app-store/

Did you check, if iPhoto is really gone from the Applications folder? You should not be seeing an "Update", if you do not have iPhoto installed any longer. Make sure, it has been deleted from "Applications".

Then go to the main page of the App Store ("Featured") and search for iPhoto. If iPhoto is now showing as "Free", buy it for free to install it again.
