What do you mean "resets"?  A Reset normally means the iPod restarts and shows the Apple logo.  Are you saying that the iPod restarts unexpectedly, while you are listening to a song?  Please provide more details...

Thats exactly what i mean Kenichi. Playing track, leave for a few seconds screen will dim, then after another approx 5 seconds reset, apple logo etc.

if the screen is off the track will play fine. In fact with screen off it played fine for 4hrs with no reset and to prove a point i went back to the album view, left it for the few seconds and again the reset. Latest update is installed etc.

This is a new device, just out box. Purchased on amazon as a gift and once the birthday came was out of returns window. Wasnt really something i could test for or it could have been returned.

Do a Restore using iTunes, if you have not already

If that does not make it work properly, it may be beyond the "return for refund" window, but it's still under warranty (for one year).  If there is an Apple Store nearby, make a reservation at the store's Genius Bar and take it there.  That seems to be a problem that you can easily demonstrate.  Otherwise, you can contact Apple's tech support using the Contact Us link at the bottom right corner of this window.
