It does indeed look like being an educational institution is a requirement to create an iTunes U course, according to this article:
Enroll as an Institution.
K-12 school districts, colleges, and universities can distribute courses and collections of education content by signing up with Public Site Manager.

The license agreement also spells out the terms of usage. It is presented when you create your teacher account.
