If not, you can't activate the device but may be able to get it refunded.
Apple won't remove the lock for anyone other than the original owner(assuming they're alive.)

Streamlined email process for removing activation lock
AppleCare has announced a new process to assist institutions with returned devices which may be activated locked. For customers who experience this for the first time please call AppleCare at 800-800-2775 so that the process and needed documentation can be explained. After the initial call customers can email with the required documentation for all Activation Lock Removal requests.

Jan 15, 2015 8:24 AM in response to tamifromgreat bendby dan_o_00,More than likely the previous user had Find my iPad enabled, thus putting the iPad into Activation Lock once it was wiped. Like stated above the only way past is having access to the Apple ID, contacting Apple with serial number and proof of purchase, or possibly removing the Activation Lock via MDM.
