Q: Apple says Mavericks is UNAVAILABLE!!!

I was on the phone with them today and that’s what the tech rep told me.

He said and I quote “Yosemite is the best operating system we’ve ever made and there’s nothing wrong with it.”

He asked me why I needed Mavericks anyway and that the bad reviews on the app store are from “users, and they don’t know what they’re talking about”. He then went on to say, “the professional reviews are all good!”

So, then I asked if I could buy the thing and he said…No, It’s not available and that I should download Yosemite because it’s better!

So there you have it. No more Mavericks.

iMac, OS X Mavericks (10.9.4), 3.06 GHz Intel Core i3

Anyone with Ipad Iphone and Ipod updated to IOS8 would have to update to Yosemite in order to use the latest version of ICLOUD across all devices.

Because Maverick is unavailable - possible a number of users pulled it down and will pull down the updates until whatever the release is called next year before it is installed.

There are companies who wait to update to next operating system release a least a year -simply because they want someone else to work the bugs out - particularly if they don't have a large IT staff.

This situation has turned into an opportunity for some people. You can buy a Mavericks  flash drive on eBay. Good feedback on a number of those transactions, too.

Great way to mess up your mac as the seller would have signed in with their profile - of course it may have malware in it.

Besides being illegal, you are opening yourself up to so much malware with a deal like that plus setting your Mac up so that it can never be upgraded again because of the operating system that is purchased with some one else's AppleID.

I say that is a deal worthwhile avoiding.

In what way is it illegal? It's a "free" OS. The sellers will say that they are selling the flash drive, which has the free OS on it. And eBay had not pulled the auctions.

I've heard differing opinions on whether Mavericks is tied to an ID or not.

Even though Mavericks is free, Apple has you purchase it which ties it to your AppleID.

It is tied to the ID of the account that downloaded it.

    It is also illegal.

Among the other reasons already stated, Apple is the author and sole owner of the software. They own the copyright and only they have the legal right to distribute it, free or not.

Promoting illegal purchase of Mac OSX

And eBay had not pulled the auctions.

Actually they did about a week ago after I reported one. Ebay does not verify anything sold on its site: if I say it complies with the law, they will let me offer it - until someone reports it as illegal. Then they will remove it. One of the flash drive sellers actually added a comment that his item complied with ebay's copyright laws (which it did not). The fact is that the app store is the only place you can obtain Mac OS and its' updates legally (unless it is installed as the OS in a Mac computer you are buying).

FWIW, at least 90% of software sold on ebay is illegally obtained, pirated, or whatever.

I reported **** about an hour ago. Not only illegal, but a heavily modified version for a Hackintosh. It'll probably sell before eBay gets around to removing it.

There is also a site that appears to be another mac forum that is offering downloads of mavericks.

I deleted my history - found it through a search question about yosemite -- looked like legit postings

-- but who knows - scams do get fancies.

As I said earlier: if it's not from the App store, it violates the licensing agreement. Apple rolled out the current digital download system with the tie-in to the Apple ID to cut down on software piracy (IMHO). Even when downloading/buying from the app store, you are not buying the software - you are merely granted a license to use it and the terms are all spelled out in the SLA. Here are two excerpts from the SLA and they specifically exclude several things:

    B. Mac App Store License. If you obtained a license for the Apple Software from the Mac App Store, then subject to the terms and conditions of this License and as permitted by the Mac App Store Usage Rules set forth in the App Store Terms and Conditions (http://www.apple.com/legal/internet-services/itunes/ww/) (“Usage Rules”), you are granted a limited, non-transferable, non-exclusive license:to download, install, use and run for personal, non-commercial use, one (1) copy of the Apple Software directly on each Apple-branded computer running OS X Mavericks, OS X Mountain Lion, OS X Lion or OS X Snow Leopard (“Mac Computer”) that you own or control;

    and:

    H. Other Use Restrictions. The grants set forth in this License do not permit you to, and you agree not to, install, use or run the Apple Software on any non-Apple-branded computer, or to enable others to do so. Except as otherwise permitted by the terms of this License or otherwise licensed by Apple: only one user may use the Apple Software at a time, and (ii) you may not make the Apple Software available over a network where it could be run or used by multiple computers at the same time. You may not rent, lease, lend, sell, redistribute or sublicense the Apple Software.

Unfortunately Apple's discontinuing of selling it on media - or custom putting an order unto media as an option to users who for one reason or another cannot do a direct down-load - is causing the problem of bogus sites or people selling the software on e-bay.

I think this whole Yosemite vs. Mavericks thing is split right down the middle. I'm just worried because I bought this computer with Mavericks on it, someone upgraded it before selling it to me. If I go to Yosemite, I'm not sure I can get back. Or can I? To Mavericks, that is.

You can restore the original OS if you have a recovery partition that was made with that OS version.

Use recovery disk assistant to generate a copy whilst you have 10.9 installed, then you can restore that to go bad to 10.9

OS X: About Recovery Disk Assistant - Apple Support

Internet recovery mode may also install the original OS version, however it may also install the last used OS.
