Also do a hard reboot: Hold down the Home and Wake/Sleep buttons at the same time for about 15 seconds until the Apple logo appears. Ignore the "Slide to power off" text if it comes up. You will not loose anything.
If neither of these help post back and I will offer more details....

Have you looked at these options? My guess is yes.

yes have tried everything there!
It also wont connect to the App store? but everything else works fine using 3G.

I would try connecting at a public place like a coffee shop and see if you can get it to work there. Since your other devices work at home it is unlikely to be your ISP or router. If it does NOT connect at a coffee shop ask for your money back as it is defective. If it does connect at other places you could try a complete reset but I don't think it will help you. There is a thread on this forum about iOS 8 issues with Wi-Fi. Most phones work fine but a subset of devices, both iPads and iPhones, are having issues. Take a look here:
Over 200 pages of posts and no need to go through them as no one has found a definitive answer other than to wait for iOS 9 which is scheduled for release in the fall.

Aug 11, 2015 10:42 AM in response to Philly_Phanby laurenmcki,I've literally only received it today so i'm unsure, I haven't Tried to connect to a different wifi so i'm unsure if it will work with something else. Icloud/App store haven't worked at all since I've set it up.

You may want to try connecting to an open Wi-Fi, such as a coffee shop as indicated earlier. If you cannot connect to a non-protected public Wi-Fi, then it is possible there is a problem with the Wi-Fi on the phone. What does the seller have to say when you question them about the Wi-Fi functioning?
Just read your last post, have you tried updating the device via iTunes, then checking the Wi-Fi?
