Error 39 is an iTunes connectivity issue. First please check this article and see if it helps. Then post back and if not I will offer other options.

Also on the "forgot the passcode" issue this should help: If you forgot the passcode for your iPhone, iPad, or iPod touch, or your device is disabled - Apple Support
